The National Council for Combating Corruption of the Republic of Tajikistan

The National Council for Combating Corruption of the Republic of Tajikistan (hereinafter – National Council) is a nationwide consultative body that coordinates the activities of state authorities and engages civil society in implementing measures to prevent and combat corruption. It was established by Decree of the President of the Republic of Tajikistan dated December 14, 2010, No. 968, and is accountable to him. 

In its activities, the National Council is guided by the Constitution of the Republic of Tajikistan, constitutional laws, laws, decrees of the President of the Republic of Tajikistan, and other regulatory legal acts of the Republic of Tajikistan.

The main objectives of the National Council include: 

- Analysis and consideration of issues related to combating corruption and coordinating the activities of state authorities and civil society in preventing and fighting corruption; 

- Promoting the implementation of the requirements of regulatory legal acts of the Republic of Tajikistan, international legal acts recognized by the Republic of Tajikistan, the Anti-Corruption Strategy in the Republic of Tajikistan for 2013–2020, and other national anti-corruption programs; 

- State and public monitoring of corruption prevention and effective performance of state authorities in combating corruption, as well as evaluating the activities of state authorities and other organizations in this area; 

- Broad involvement of non-governmental organizations, civil society, and citizens in combating corruption; 

- Eliminating threats to the economic security of the country, preventing factors and conditions conducive to corruption, promoting public awareness of the dangers of corruption, and fostering an atmosphere of intolerance towards corrupt practices. 

 

The tasks of the National Council include: 

- Assisting in identifying priority areas for the activities of state authorities in preventing and combating corruption; 

- Proposing measures to define, approve, and implement state policy in the field of combating corruption; 

- Coordinating the activities of state authorities and local self-government bodies of towns and villages to implement state anti-corruption policy; 

- Monitoring and evaluating the activities of state authorities and local self-government bodies in implementing anti-corruption measures; 

- Overseeing the implementation of corruption prevention measures and eliminating causes and conditions conducive to corruption; 

- Fostering an atmosphere of intolerance towards corruption and raising public awareness of its dangers, engaging constructive societal forces in combating corruption through state-civil society cooperation; 

- Performing other tasks stipulated by the regulatory legal acts of the Republic of Tajikistan. 

 

The National Council has the following rights: 

- Developing proposals to improve the activities of law enforcement agencies, other state authorities, and local self-government bodies in preventing and combating corruption; 

- Requesting necessary information from relevant authorities in accordance with established procedures; 

- Inviting heads of state authorities, local self-government bodies, and public organizations to participate in National Council meetings and hearing their reports on issues related to preventing and combating corruption; 

- Establishing commissions and working groups when necessary; 

- Exercising other rights provided for by the regulatory legal acts of the Republic of Tajikistan.

The National Council consists of a chairperson, members, and a secretary. The chairperson of the National Council is the Prime Minister of the Republic of Tajikistan. 

Members of the National Council include: 

- Assistant to the President of the Republic of Tajikistan on legal issues – Authorized Representative of the President in the National and Representative Chambers of the Parliament of the Republic of Tajikistan; 

- Assistant to the President of the Republic of Tajikistan on personnel issues; 

- Assistant to the President of the Republic of Tajikistan on social development and public relations issues; 

- Assistant to the President of the Republic of Tajikistan on national security issues; 

- Chairperson of the Committee of the National Chamber of the Parliament on Constitutional Foundations, Human Rights, Freedoms, and Legality; 

- Chairperson of the Committee of the Chamber of Representatives of the Parliament on Defense and Law Enforcement; 

- Chairperson of the Supreme Court of the Republic of Tajikistan; 

- Chairperson of the Higher Economic Court of the Republic of Tajikistan; 

- Director of the Agency for State Financial Control and Combating Corruption of the Republic of Tajikistan; 

- Prosecutor General of the Republic of Tajikistan; 

- Director of the Agency for Public Service under the President of the Republic of Tajikistan; 

- Minister of Internal Affairs of the Republic of Tajikistan; 

- Minister of Justice of the Republic of Tajikistan; 

- Minister of Defense of the Republic of Tajikistan; 

- Minister of Finance of the Republic of Tajikistan; 

- Chairperson of the State Committee for National Security of the Republic of Tajikistan; 

- Commissioner for Human Rights in the Republic of Tajikistan; 

- Director of the Drug Control Agency under the President of the Republic of Tajikistan; 

- Head of the Customs Service under the Government of the Republic of Tajikistan; 

- Chairperson of the Tax Committee under the Government of the Republic of Tajikistan; 

- Head of the Financial Monitoring Department under the National Bank of Tajikistan; 

- Leaders of political parties represented in the Chamber of Representatives of the Parliament of the Republic of Tajikistan; 

- Chairperson of the Federation of Independent Trade Unions of Tajikistan; 

- Chairperson of the Islamic Center of the Republic of Tajikistan; 

- Chairperson of the Union of Journalists of Tajikistan; 

- Chairperson of the Youth Union of Tajikistan; 

- Chairperson of the Writers' Union of Tajikistan; 

- Chairperson of the Association of Entrepreneurs of Tajikistan; 

- Chairperson of the public organization “Committee for Work with Internationalist Soldiers of the Republic of Tajikistan”; 

- Chairperson of the Council of Elders of the Public Movement for National Unity and Revival of Tajikistan.

Regulations of the National Council for Combating Corruption
of the Republic of Tajikistan

1. General Provisions

  1. The National Council for Combating Corruption of the Republic of Tajikistan (hereinafter referred to as the National Council) is a national consultative body that coordinates the activities of state authorities and engages civil society in implementing measures to prevent and combat corruption. The Council was established by the Decree of the President of the Republic of Tajikistan and is accountable to him.
  2. The National Council is guided in its activities by the Constitution of the Republic of Tajikistan, constitutional laws, laws, decrees of the President of the Republic of Tajikistan, and other regulatory legal acts of the Republic of Tajikistan (Decree of the President of the RT dated 05.06.2017 No. 887).

2. Objectives and Tasks of the National Council

  1. The main objectives of the National Council are as follows:
  • Analysis and consideration of issues related to combating corruption, and coordination of the activities of state authorities and civil society in preventing and fighting corruption;
  • Promoting the implementation of the requirements of regulatory legal acts of the Republic of Tajikistan, international legal acts recognized by the Republic of Tajikistan, the Strategy for Combating Corruption in the Republic of Tajikistan for 2013–2020, and other national anti-corruption programs (Decree of the President of the RT dated 14.06.2014 No. 214);
  • Conducting state and public monitoring of corruption prevention and the effective performance of state authorities in combating corruption, as well as evaluating the activities of state authorities and other organizations in this area;
  • Broad engagement of non-governmental organizations, civil society, and citizens in combating corruption;
  • Eliminating threats to the economic security of the country, preventing factors and conditions conducive to corruption, promoting public awareness of the dangers of corruption, and fostering an atmosphere of intolerance toward corrupt practices.
  1. The tasks of the National Council include:

  • Overseeing the implementation of corruption prevention measures and eliminating the causes and conditions conducive to corruption;
  • Fostering an atmosphere of intolerance toward corruption and raising public awareness of its dangers, engaging constructive societal forces in combating corruption through state-civil society cooperation;
  • Performing other tasks as provided for by the regulatory legal acts of the Republic of Tajikistan.

3. Rights of the National Council

  1. The National Council has the following rights:
  • Developing proposals to improve the activities of law enforcement agencies, other state authorities, and local self-government bodies in preventing and combating corruption;
  • Requesting necessary information from relevant authorities in accordance with established procedures;
  • Engaging heads of state authorities, local self-government bodies, and public organizations in the Council’s meetings and hearing their reports on issues of corruption prevention and combating;
  • Establishing commissions and working groups as needed;
  • Exercising other rights provided for by the regulatory legal acts of the Republic of Tajikistan.

4. Composition of the National Council

  1. The National Council consists of a Chairperson, members, and a Secretary.
  2. The Chairperson of the National Council is the Prime Minister of the Republic of Tajikistan.
  3. The members of the National Council are:
  • Assistant to the President of the RT on Legal Issues – Authorized Representative of the President of the RT in the National Assembly and the House of Representatives of the Supreme Assembly of the RT (Decree of the President of the RT dated 14.06.2014 No. 214);
  • Assistant to the President of the RT on Personnel Issues (Decree of the President of the RT dated 14.06.2014 No. 214);
  • Assistant to the President of the RT on Social Development and Public Relations (Decree of the President of the RT dated 14.06.2014 No. 214);
  • Assistant to the President of the RT on National Security Issues (Decree of the President of the RT dated 14.06.2014 No. 214);
  • Chairperson of the Committee of the National Assembly of the Supreme Assembly of the RT on Ensuring the Foundations of Constitutional Order, Human and Civil Rights, Freedoms, and Legality;
  • Chairperson of the Committee of the House of Representatives of the Supreme Assembly of the RT on Defense and Law Enforcement;
  • Chairperson of the Supreme Court of the RT;
  • Chairperson of the Higher Economic Court of the RT;
  • Excluded (Decree of the President of the RT dated 05.06.2017 No. 887);
  • Director of the Agency for State Financial Control and Combating Corruption of the RT;
  • Prosecutor General of the RT;
  • Director of the Agency for Public Service under the President of the RT (Decree of the President of the RT dated 14.06.2014 No. 214);

  • Minister of Justice of the RT;
  • Minister of Defense of the RT;

  • Ombudsman for Human Rights in the RT;
  • Director of the Drug Control Agency under the President of the RT;

  • Head of the Financial Monitoring Department under the National Bank of Tajikistan;
  • Leaders of political parties represented in the House of Representatives of the Supreme Assembly of the RT;

  • Chairperson of the Council of Elders of the Public Movement for National Unity and Revival of Tajikistan (Decree of the President of the RT dated 30.11.2019 No. 1378).
  1. Members of the National Council are obliged to participate in its meetings. They cannot delegate their powers to another person.

5. Powers of the Chairperson of the National Council

  1. The Chairperson of the National Council has the following powers:
  • Convenes meetings of the National Council;
  • Conducts and chairs the meetings of the National Council;
  • Signs the decisions of the National Council;
  • Establishes commissions and working groups from among the members of the National Council, representatives of other state authorities, public organizations, experts, scientists, and specialists on specific issues of the Council’s activities and hears their reports;
  • Issues instructions and directives to relevant ministries and agencies to implement the decisions of the National Council;
  • Exercises other powers related to the activities of the National Council.
  1. The Secretary of the National Council is appointed and dismissed by the President of the Republic of Tajikistan. The Secretary is the Head of the Defense and Law Enforcement Department of the Executive Apparatus of the President of the RT and carries out their duties on a permanent basis. The Secretary ensures the informational, analytical, and organizational-technical support for the activities of the National Council (Decree of the President of the RT dated 14.06.2014 No. 214).
  2. The duties of the Secretary of the National Council include:
  • Preparing the agenda for the National Council’s meetings;
  • Organizing the Council’s record-keeping;
  • Preparing and summarizing appeals and other documents received by the National Council and submitting them to the Chairperson;
  • In collaboration with Council members, preparing necessary documents on issues under consideration and draft decisions for submission to the Chairperson and members of the National Council;
  • Preparing the decisions of the National Council and submitting them for the Chairperson’s signature;
  • Organizing, through the media, the coverage of the National Council’s activities and its decisions;
  • Monitoring the implementation of the National Council’s decisions;
  • Carrying out the instructions of the Chairperson and other duties related to the National Council’s activities in accordance with the regulatory legal acts of the Republic of Tajikistan.
  1. The Agency for State Financial Control and Combating Corruption of the RT assists the Secretary of the National Council in analyzing and summarizing issues discussed at the Council’s meetings.

6. Operating Procedures of the National Council

  1. The National Council considers important issues related to combating corruption in the Republic of Tajikistan and adopts decisions formalized in protocols signed by the Chairperson of the National Council.
  2. Meetings of the National Council are held at least once a year. Extraordinary meetings of the National Council are convened as needed at the initiative of the Chairperson or more than half of its members.
  3. The agenda and materials for discussion are sent to the members of the National Council no later than three days before the meeting.
  4. Meetings of the National Council are held with the participation of at least two-thirds of its members.
  5. Decisions of the National Council are adopted by open voting and with the support of the majority of participants present at the meeting.
  6. The National Council may invite heads of ministries and agencies, chairpersons of regions, cities, and districts, heads of local self-government bodies, heads of enterprises, institutions, other organizations, and officials to its meetings to hear their reports. If necessary, the National Council may invite scientists, experts, and specialists to provide conclusions on issues discussed at its meetings.

7. Financial Support for the National Council’s Activities

  1. The financing of the National Council’s activities and its Secretary is provided from the republican budget.

8. Final Provisions

  1. The establishment, reorganization, and dissolution of the National Council are carried out by the President of the Republic of Tajikistan in accordance with the legislation of the Republic of Tajikistan.
